By accessing or using the Caliberate athletic training platform (the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Platform. These Terms constitute a legally binding agreement between you and Caliberate ("we," "us," or "our").

2. Description of Service

Caliberate is an athletic training platform that provides tools for coaches and athletes to manage training programs, track performance metrics, analyze video submissions, schedule sessions, and communicate. The Platform includes AI-powered coaching insights, workout assignment and tracking, performance analytics, and integration with third-party wearable devices. We reserve the right to modify, suspend, or discontinue any part of the Platform at any time.

3. User Accounts

To use the Platform, you must create an account and provide accurate, complete information. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activity that occurs under your account
• Notifying us immediately of any unauthorized use
• Ensuring that any information you provide is accurate and up-to-date

If you are under 18 years of age, you must have consent from a parent or legal guardian to create an account and use the Platform.

4. Acceptable Use

You agree not to use the Platform to:

• Violate any applicable law, regulation, or third-party rights
• Upload or transmit harmful, offensive, or misleading content
• Attempt to gain unauthorized access to other accounts, systems, or data
• Interfere with the operation of the Platform or its infrastructure
• Use automated means (bots, scrapers) to access the Platform without our written permission

5. Intellectual Property

The Platform, including its design, software, content, logos, and branding, is owned by Caliberate and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Platform without our prior written consent.

Content you upload to the Platform (such as videos, training logs, and profile information) remains yours. By uploading content, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and process that content as necessary to provide and improve the Platform.

6. Limitation of Liability

The Platform is provided "as is" and "as available" without warranties of any kind, whether express or implied. To the fullest extent permitted by law:

• We do not guarantee that the Platform will be uninterrupted, error-free, or secure
• We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform
• Our total liability to you for any claims arising from these Terms or your use of the Platform shall not exceed the amount you paid us in the twelve (12) months preceding the claim
• Training recommendations and AI-generated insights are for informational purposes only and do not constitute professional medical or athletic advice

7. Termination

You may terminate your account at any time by contacting us. We may suspend or terminate your access to the Platform at any time, with or without cause, and with or without notice. Upon termination, your right to use the Platform ceases immediately. We may delete your account data in accordance with our Privacy Policy. Provisions of these Terms that by their nature should survive termination (including intellectual property, limitation of liability, and dispute resolution) will remain in effect.

8. Changes to Terms

We may update these Terms from time to time. When we make material changes, we will notify you by email or through a notice on the Platform. Your continued use of the Platform after changes are posted constitutes acceptance of the updated Terms. If you do not agree to the revised Terms, you must stop using the Platform.
